Case of Yelia Apparel Trademarks: It is not Unexpected to Claim Victory

Liu Xiaofei, an attorney at Beijing Guolian Law Firm, recently collaborated with Dai Jiapeng, an employee at Beijing Guolian Xingye Intellectual Property Agency Co., Ltd. They represented Shandong Yeliya Garment Group Corporation and Yilian Group (referred to as Yeliya), led by Yuan Wenhe. Their mission was to address trademark infringement and unfair competition claims against Seimi Fashion (Beijing) Co., Ltd. (referred to as "Sail"). Following a lengthy legal battle, the case concluded favorably for Yeliya just a few days ago. As Liu Xiaofei explained, the outcome wasn’t entirely surprising. He noted that Yelian's success stemmed from their unwavering dedication, persistence, and strategic approach. “The plaintiff demonstrated remarkable commitment,” Liu emphasized. “Their efforts were commendable and should serve as an example for others facing similar challenges.” One of Yelian's key strengths was their proactive response to potential infringements. If unauthorized discount stores or websites appeared, Yelian swiftly dispatched undercover investigators to gather concrete evidence. This information was then presented to local industry and commerce authorities, ensuring the evidence could be used effectively in court. Liu advised, “If your business suffers significant infringement, it’s crucial to document everything meticulously and seek legal support early.” Yelian also maintained a steadfast adherence to legal principles throughout the process. Instead of resorting to extreme measures, they pursued legitimate avenues to protect their rights. Additionally, leveraging professional legal counsel proved invaluable in navigating the complexities of intellectual property law. In the end, Yelian achieved a favorable judgment, securing compensation totaling 300,000 RMB—a substantial amount compared to similar cases. Zhang Zhonghua, Yelian’s president, expressed satisfaction with the outcome despite acknowledging it couldn't fully compensate for the company’s losses. “The legal system worked in our favor,” he remarked. “This verdict strengthens our resolve to fight for justice.” Reflecting on the journey, Zhang highlighted the importance of persistence. “While it took considerable effort, it was well worth it,” he said. During this process, Yelian also gained valuable insights into gathering evidence and understanding legal procedures. “We now know exactly what steps to take and where to look,” Zhang added. Post-victory, Yelian plans to bolster its internal infrastructure. Setting up regional offices in major cities like Beijing and Shanghai is part of their strategy. By expanding their network of self-operated stores, Yelian aims to solidify its position in the domestic market. Their focus remains on tailored suits and formal wear, targeting sectors such as banking, finance, and telecommunications. Consequently, their market share among group clothing has risen from 40% last year to 55%. This experience underscored the necessity of collaboration among multiple stakeholders—courts, industry regulators, and media outlets—to ensure timely protection of rights. As Zhang concluded, “Only through collective action can we truly defend our interests.”
