Illegal trading of more than 1 kg of ivory can go to the death penalty

Recently, the reporter learned from the Yongkang People's Procuratorate that the former Jinhua CPPCC member, Jinhua City Licheng District People's Congress (has been suspended) Shao Yanfang suspected of illegally buying and selling 36 ivory cases, has now entered the stage of review and prosecution.

This is the largest illegal ivory transaction case seized locally in recent years.

At the end of 2013, when Jinhua police investigated a criminal case, 16 ivory were found from Shao Yanfang's home. After that, her husband took the initiative to hand over six ivory to the police. Since then, the case has been filed by the Jinhua Public Security Bureau designated Yongkang Public Security Bureau for investigation.

It is reported that the seller of the case is a brother of Jinhua and Wang. The Wang brothers have long been engaged in the business of sandstone and other materials. They obtained the supply from the Jiangxi sellers and then sold them to Shao Yanfang, who is doing the project, to earn the difference. At present, the Wang brothers have been arrested. According to their account, in recent years, they have sold a total of 36 ivory Shao Yanfang, of which 14 have not been known.

On December 27, 2013, Shao Yanfang was arrested and brought to justice. On March 27 this year, the case was transferred to Yongkang City Procuratorate by Yongkang Police. "The case has entered the review stage, and it is estimated that it will soon enter the litigation process." Director Xing of the Yongkang City Procuratorate Office said.

Born in 1966, Shao Yanfang was the chairman of Jinhua Zhengpeng Construction Engineering Co., Ltd., a member of the Jinhua CPPCC, and a representative of the Eighth People's Congress of Licheng District, Jinhua City. According to public reports, on November 5, 2013, she also went to Jinhua Qisheng School (formerly Jinhua Deaf School) to bring 50,000 yuan to her children.

Wu Weiqing, a lawyer at Zhejiang Haihao Law Firm, believes that since 1989, when China and the United Nations signed a convention banning the trade in ivory and products, it is not allowed to trade in any form of ivory. More than one kilogram of ivory is a criminal offence, up to the death penalty.

Wu said that the 1989 United Nations Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) completely banned the ivory trade. On July 15, 2008, the CITES Standing Committee agreed that China will become a partner in the African ivory trading. Subject to international conventions and Chinese laws, ivory trade and import and export are strictly restricted in China.

Lawyer Wu said that China’s law sets three penalties for illegally carrying ivory entry: smuggling of precious animal products worth less than 100,000 yuan is classified as “lighter case”, imprisonment for up to five years, and fines; smuggling of precious animals If the value of the product is more than 100,000 yuan and less than 200,000 yuan, it shall be sentenced to fixed-term imprisonment of not less than 5 years and less than 10 years, and fined; if the value of smuggled precious animal products is more than 200,000 yuan, it shall be "specially serious" and shall be sentenced to 10 years in prison. Or life imprisonment and confiscation of property.
